River Plate's Diego Buonanotte has been charged with triple manslaughter after a car accident late last year that killed three of his friends.
Buonanotte was excused from training on Tuesday after being called to appear in front of authorities deciding whether the 22-year-old should be charged with three counts of manslaughter following the fatal car crash last Christmas.
Buonanotte was driving in heavy weather in Buenos Aires Province on Boxing Day 2009 when he lost control and came off the road. Three of his friends were killed in the crash, and the promising playmaker was left gravely injured and only recently returned to play football.
'El Enano' survived because he was the only person in the vehicle who was wearing a seatbelt.
Reports at the time revealed studies made on the car and the crash scene indicated a possibility that careless driving was at fault for the tragedy - hence this week's meeting with local prosecutor Carlos Colimedaglia to declare Buonanotte's recollections of the accident.
And after the discussion, the prosecutor decided there was enough evidence to bring a legal case.
"Buonanotte is charged with triple manslaughter and eventually this is likely to go to court to determine whether he is guilty," Colimedaglia told Reuters.
"He said that he does not remember the moment of the accident and does not know how it happened," the prosecutor added to Telam.
"He gave us a rundown of that day with his friends; they were playing paddle and football, they went to a barbeque and then to a pub in Ferré, and when they were coming back from there the accident occurred."
Colimedaglia also revealed that the youngster told all that he could "because he is still very upset and broken over the incident". But even though Buonanotte may not have been speeding or under the influence of alcohol at the time of the incident, a failure to take into account the inclement weather of that morning may have led to him driving inappropriately.
"There is a variety of factors (which led to the crash)... He did not have complete control of the vehicle in the crucial moment," he noted.
"It is not the same driving at 100km/h on a sunny day and with perfect conditions and visibility, adoing it in torrential rain, gusts of wind and with the road covered in water."
On Monday, Buonanotte's legal assistant warned that the case against his client
"lacked sufficient legal grounds."
"In all traffic accidents the prosecutor tries to determine whether the actions of anyone involved have contributed to the outcome," Dario Del Ciervo told a local radio station.
